Privacy Policy

This Privacy Policy (“Policy”) applies to your use of our website and any software or mobile apps that we may create (together, we call those things the “Service”). By visiting our website, downloading our apps, registering for any Services, or by using any Service offering, you agree to be legally bound by this Policy.

Quickly, we have some housekeeping to cover: The Service provided by Let’s Talk Podcasting Inc. but in this Policy, we are called “LTP”, “we” or “us”. Those references also include our affiliates and subsidiaries. We refer to you (and anyone else using the Service) as “User” or “you.” This Policy is incorporated into the LTP Terms of Use.   1. What does this policy cover? This Policy covers how LTP collects and uses your personal information. Personal information is any information that can be used to identify you. It does not include data where the identity information has been removed (like anonymous data). It also explains how you control use and collection of your information.
  2. Information we collect and use. Other than your username, all information you make available via the Service is stored only on your local device. We have no access to such information. We cannot store, collect, or otherwise use that information. We designed the Service this way to ensure that we comply with applicable privacy laws, especially in relation to use of the Service by Users under 13 years of age. On this note - if you are under the age of 13, do not include your real name (first name or last name) as part of your username. Subject to the foregoing, the only personal information we may collect and use includes: any personal information you include in your username, and any personal information you provide to us outside of the Service (e.g. name and email address if you contact us directly).
    1. Cookies. Our Service does not use cookies.
    2. Log file information. Anytime you use the Service, our servers may record ‘log file information.’ I’m sure you are asking – what is log file information? Well, it’s a bunch of information about your browser and interaction with the Service which doesn’t identify you directly. This includes your Internet Protocol (“IP”) address, web request, browser type, referring exit pages and URLs, number of clicks you make on the Service, how you interact with the Service, domain names, landing pages, pages viewed and other similar information. We use log file information to improve functionality of the Service; we don’t use it for marketing purposes.
  3. How we use your information. We use the information we collect about you for the following purposes:
    1. Providing you with the Service.
    2. Improve the Service and our users’ experience, including by monitoring aggregate (or anonymized) metrics such as total number of visitors, traffic, and demographic patterns.
    3. We use your contact information to get in touch with you and to send communications about critical elements of the Service. We will not send you marketing, promotional or special offer information unless you opt-in to such communications.
    4. To monitor activity that we think is suspicious or potentially fraudulent, and to identify violations of this Policy or our Terms of Use.
    5. For matters that you have specifically consented to: From time to time, LTP may seek your consent to use your information for a particular purpose. Where you no longer want us to use your information for that purpose you may withdraw your consent to this use by emailing info@letstalkpodcasting.com (even simpler, right?), and we will make this change on a going forward basis.
    6. Where we are required to use your information by law: LTP will use or disclose your information where we reasonably believe that such action is necessary to: (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of LTP, our users or others.
  4. California Privacy Notice. LTP users in California – this section applies to you! California Civil Code Section 1798.83 permits users of the Services that are California residents to Request access to, correction of, or deletion of your personal information; request information about the categories of personal information we collect, use, disclose, and “sell” or “share”; Opt out of the sale or sharing of your personal information for targeted advertising; Limit the use of sensitive personal information. To make such a request, please send an email to info@letstalkpodcasting.com. We do not sell personal information for monetary consideration. We do not respond to Do Not Track signals
  5. Sharing your information. Except as noted in this section, we will not share, rent or sell your information to third parties (that means anyone other than you or LTP) without your consent. You agree that LTP is not responsible for how third parties collect, manage or use your personal information; see their Privacy Policies for more details on that.
    1. Service Providers. We may share your information with third party service providers for the purpose of providing the Service. Those service providers will only be provided with access to your information as is reasonably necessary for the purpose that LTP hired the service provider for. We require that third parties comply with this Privacy Policy and any applicable laws. These third party service providers include those that assist LTP with functions such as: i. Customer support and customer management; ii. Email services; iii. Hosting and storage; and iv. Analytics.
    2. Upon Sale. If we sell our business, any of the info which we’ve acquired about you may be included in the sale. More specifically, LTP may share your information with a third party in circumstances where we sell, divest or transfer LTP (including any shares in LTP), or any combination of its products, services, assets and/or businesses to a third party. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of LTP.
    3. For Protection. We may share your information with the proper third parties if we think it’s necessary to: i. Detect, prevent or address illegal activity; ii. protect you or LTP, such as where we consider that there is a need to investigate potentially fraudulent or criminal activity; iii. To bring legal action against someone that is injuring or interfering with your rights, user rights, or LTP rights; iv. Comply with court orders, subpoenas or other legal requirements; or v. Protect the safety of others, including emergencies regarding potential harm, loss of security or serious injury to people or threats of those emergencies.
  6. Children’s privacy. If you are under 13 years old, we can’t accept your personal information (in fact, it would be against some laws for us to collect it!). So, please don’t include any personal information (like your real name) in your username. Otherwise, you can use the Service as we don’t collect or have access to the content you make available (e.g. podcast recordings). All that content is available on your device only (through local access). Users in the EEA, please see the “Processing Information under the GDPR” section below. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.   7. How we transfer, store and protect your data. To run our Service, we may use computers located across the world. This means your information might be transferred to the US, Australia, Europe and anywhere else the service is operated. These countries and jurisdictions may not have the same data protection laws as your jurisdiction. Except where you are in the EEA, you consent to the transfer of information to Canada or any other country in which LTP or its service providers maintain facilities – if you’re in the EEA, please see paragraph 9 below.
  8. Cross-border transfers of information (for users in the EEA). For Users in the EEA, where we transfer your information to a third party provider that is not located in the EEA, and is not subject to an adequacy decision by the EU Commission, we will require those third party providers to enter into an agreement that provides appropriate safeguards for your information. You can contact us at info@letstalkpodcasting.com for a copy of the safeguards which we have put in place to protect your personal information and privacy rights in these circumstances.
  9. Keeping your information safe. We use proper safeguards to preserve the integrity and security of all information collected through the Service. Despite our good practices, LTP cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur, and we cannot guarantee the security of your information. Please also remember that LTP is not responsible for the functionality or security measures of any third party.
  10. Compromise of information. If any information under our control is compromised as a result of a breach of security, LTP will take all reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.
  11. Your choices about your information. Permitting you opted-in, you can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of Service-related communications (e.g., account verification, changes/updates to features of the Service, technical and security notices). Please refer to your mobile device or browser’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Disabling cookies and/or other tracking tools will prevent LTP (or authorized third parties) from tracking your browser’s activities in relation to the Service and for use in targeted ads by Advertisers. However, doing so may also disable some features available through the Service.   12. Rights in respect of your Information. You have the right to: Be informed of the ways we use your information (as we seek to do in this Policy); Request a copy of your information; Request that we correct inaccuracies relating to your information; Withdraw consent that you have previously provided to us (for example, consent to contact you by email for marketing purposes); Request that your information be deleted if you withdraw consent, there is no longer a reason for us to use it, or if we have no lawful basis for keeping it; Request a structured electronic version of your information; Object to our use of your information; and Restrict the personal information we use about you where you have asked for it to be erased or where you have objected to our use of it.
    To make a request for any reason listed above, please contact us at info@letstalkpodcasting.com. In some circumstances LTP may not be able to comply with a request that you make in respect of your personal data. For example, we may be required to retain certain information that you ask us to delete for various reasons, such as where there is a legal requirement to do so. If we are unable to resolve your request, or if you are concerned about a potential violation, you may be entitled to report the issue or make a complaint to the data protection authority in your jurisdiction. You may have specific rights in relation to your information depending on where you live.
  13. How long we keep Your Story. The short answer – we keep your personal information for as long as necessary to deliver the Service. How long we keep the information absolutely depends on the type of information we are holding and the purpose we collected it. Legal obligations will also inform how long we will hold the information.
  14. Links to other websites and services. We are not responsible for the practices employed by websites or services linked to or from the Service, including the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy does not apply to third party websites or services. Your browsing and interaction on any third party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible for and we do not exercise control over any third-parties that you authorize to access Your Story or your Podcast Episode. If you are using a third party website or service (like Facebook) and you allow such a third party access to Your Story or your Podcast Episode you do so at your own risk.
  15. Additional privacy information for Users in the EEA. LTP users in the European Economic Area (EEA) – this section applies to you! LTP processes your information in accordance with European laws and regulations such as the General Data Protection Regulation (GDPR). The GDPR governs how LTP may process your information, and the rights that EEA users have in relation to it. This means that LTP will collect and use your information only where: a. You have given us consent; b. When it’s necessary for the performance of a contract to which you are a party; c. To take steps you request before we enter into a contract; d. When we need to comply with a legal or regulatory obligation; or e. When necessary for our legitimate interests i. Processing information because of our legitimate interest occurs when you have not actively approved the processing, but we have a legitimate purpose for the processing, it’s necessary to provide the Service, and the processing does not override your interests, rights, or freedoms (lots of lawyer talk, eh? Sorry for that, but it’s important!). If you have consented to our use of your information you may withdraw that consent at any time by emailing info@letstalkpodcasting.com. Where we are using your information because of a legitimate interest to do so, you have the right to object to that use. However, if you do this, it may not be possible for LTP to continue to provide you the Service.
  16. Changes. LTP may, in its sole discretion, modify or update this Policy from time to time; if we do so, we will give notice in advance on the Services. Your continued use of the Service after any such change constitutes your acceptance of the new Policy. If you do not agree to any of these terms or any future Policy, please do not use or access (or continue to access) the Service.
